The thing I see about the death penalty is that the same political pressure that causes certain crimes to have the death penalty attached to them also create enourmous pressure for the police to find *somebody* to prosecute for these crimes when they are commited. The only serious studythat I'm aware of , of how often the justice system gets it wrong, is Illinois which was about half the time.
From a political standpoint it's up to the individual to decide whether it's worth it to have a certain number of innocent people be put to death each year to maintain an "air of deterrence" for a given set of crimes.
