This statement is correct but it is only part of the problem. IMHO, the real meat of the problem is that the infringements are being sold to the public in the guise of patriotism and FEAR and that sales job is working. As Shrub's approval rating drops, I hope Kerry can shine some light on the artificiality of those fears and how they were created/increases for political reasons rather than being accurately reported. [Sometimes, I think Shrub's people are secretly employing Stephen King (not that I think he'd do that!)]
